1. Acceptance of Terms

By accessing or using FlowPass, you agree to be bound by these Terms and Conditions and any applicable laws and regulations. If you do not agree, do not use the service.

2. Eligibility and Accounts

You may use FlowPass only if you are legally able to enter into a binding agreement and are authorized to use the service on behalf of yourself or your organization.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Use of the Service

You agree to use FlowPass only for lawful business purposes and in compliance with applicable law.

You may not:

• Use the service to violate laws, regulations, or third-party rights.
• Interfere with the security, integrity, or performance of the platform.
• Attempt unauthorized access to accounts, systems, or data.
• Copy, reverse engineer, or exploit the service except as permitted by law.

4. Customer Content

You retain ownership of the information, materials, and content you submit to FlowPass. You grant FlowPass a limited right to host, process, transmit, and display that content as necessary to provide the service.

You are responsible for ensuring that you have all necessary rights and permissions for any content submitted through the platform.

5. Payments and Subscription Terms

Paid features may be offered on a subscription or transactional basis. Fees, billing cycles, renewal terms, and cancellation terms will be presented at the time of purchase or in your service agreement.

Unless otherwise stated, fees are non-refundable except where required by law.

6. FlowPass SMS Terms of Service

By opting in to SMS notifications from FlowPass, you agree to receive transactional text messages related to your fitness studio membership, including but not limited to: waiver signing reminders, check-in confirmations, membership and pass status updates, class and appointment reminders, and event check-in QR codes.

Message Frequency: Varies based on your activity. You may receive up to approximately 10 messages per month.

Message and Data Rates: Standard messaging and data rates from your wireless carrier may apply.

Opt-Out: You may opt out at any time by replying STOP to any message. You will receive a one-time confirmation that you have been unsubscribed.

Consent Not Required for Purchase: Your consent to receive SMS messages is not a condition of purchasing any membership, pass, or service.

Privacy: Your information is handled in accordance with our Privacy Policy at Privacy Policy. We do not share your mobile information with third parties for promotional or marketing purposes.

7. Availability and Changes

We may modify, suspend, or discontinue any part of the service at any time. We do not guarantee that FlowPass will be uninterrupted, error-free, or available at all times.

8. Third-Party Services

FlowPass may integrate with third-party products and services. We are not responsible for third-party services, content, security, or privacy practices, and your use of those services may be governed by separate terms.

9. Intellectual Property

FlowPass and its related software, branding, content, and materials are owned by FlowPass or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted, no rights are transferred to you.

10. Disclaimer of Warranties

FlowPass is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and availability.

11. Limitation of Liability

To the maximum extent permitted by law, FlowPass will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill arising out of or related to your use of the service.

12. Indemnification

You agree to defend, indemnify, and hold harmless FlowPass and its affiliates, officers, employees, and agents from claims, damages, liabilities, and expenses arising from your use of the service, your content, or your violation of these terms.

13. Termination

We may suspend or terminate access to FlowPass if you violate these terms, create risk for the platform, or if required for legal or security reasons.

14. Governing Law

These terms are governed by the laws applicable to the jurisdiction in which FlowPass operates, without regard to conflict of law principles, unless a separate written agreement provides otherwise.

15. Changes to These Terms

We may update these Terms and Conditions from time to time. When we do, we will update the effective date and post the revised terms on this page.
